Srinagar: The family members of Muhammad Afzal Mir of Garoora Bandipora have served a legal notice to Education Minister Naeem Akther for allegedly making false allegations against Mir.
The family, in legal notice, has referred the article written by Education Minister titled “Two parables and the condemned man” and asked to pay the damages /compensation of Rs 60 lakhs, failing which a case demotion case would be filed against him.
“You have published an Article “Two parables and a condemned man” in daily news paper Greater Kashmir dated 11 October, 2016 wherein you have not taken any care how the family of the Late Muhammad Afzal Mir will bear such contemptuous and baseless allegation while addressing veteran Hurriyat Leader Syed Ali Shah Geelani,” reads the notice, a copy which lies with KNS.
The family, in a legal notice served through their counsel Advocate SA Qadri, said that Akther has not taken into consideration the emotions, reputation of the late of Mohammad Afzal Mir family who were shocked when informed about the Article published in the daily news paper and received a copy of the news paper jeopardizing the rights of the family of Mir, adding, “and for your information the said Mohammad Afzal Mir was Government Employee in PHE Department.”
“That the family of Mohammad Afzal Mir asking you, you are not known to them wherefrom you hail although you are Education Minister committing such mischief a well versed, qualified person whom such things are not expected and you have not given a thought that publishing such article to pleas the Veteran Hurriyat Leader for opening of schools and neither sought any apology for this contemptuous language. Although my clients reserve right to file FIR against you defaming their father who was not illiterate and who has never deposed this kind of prayer in a Mosque,” reads the notice.
“You (Naem Akther) have not sought any apology although my clients have decided to file defamatory suit against you and you have no defense as the Article itself is a proof and explanatory evidence, so why you should not be sued before the court for defamation viz a viz for compensation Rs. 60. 00 lakhs,” it adds.
“That this notice is issued to you in anticipation to pay the damages /compensation Rs. 60 lakhs to the aforementioned client as a token of repentance. Otherwise you have to face court of law, hence this legal notice served upon you,” it concludes. (KNS)
